Civil suit dismissed in shooting of neighbor

A civil lawsuit against a Gainesville man who fatally shot his neighbor in a dispute but was cleared because of an error in a law enforcement report has been dismissed.

Randall Smith, 58, is pleased to have both the criminal and civil cases behind him, said Ron Kozlowski, his attorney. The cases stemmed from the 2014 shooting of Michael Carreiro, 47.

“Mr. Smith is very happy that his case is over and the entire saga — as difficult as it’s been for everyone, both his family and the Carreiro family — is over,” Kozlowski said.

Smith was indicted on a second-degree murder charge in part because a Florida Department of Law Enforcement report stated that Smith shot Carreiro from behind, indicating that Carreiro was fleeing. He had planned to use Florida’s “stand your ground” law as his defense.
